1. Agreeing to These Terms

Using MailCrypts means you're accepting these Terms of Service. If any part of this doesn't sit right with you, the service isn't for you. Once you sign up, this becomes a binding agreement between you and MailCrypts.

2. What the Service Covers

MailCrypts is an encrypted email service running on zero-knowledge architecture, covering secure messaging, storage, and the features that come with them. We provide it as-is and can change, pause, or shut down parts of it whenever we need to.

3. Setting Up an Account

To sign up, you need to:

  • Be 16 or older
  • Give us accurate registration details
  • Keep your login credentials safe
  • Tell us right away if your account gets accessed without permission
  • Own responsibility for whatever happens under your account

4. What You Can't Do With It

MailCrypts isn't for:

  • Breaking laws or regulations
  • Sending spam or unsolicited bulk mail
  • Spreading malware or harmful code
  • Harassing, threatening, or abusing anyone
  • Stepping on someone else's intellectual property
  • Trying to break into our systems
  • Disrupting the service or other users
  • Any illegal or fraudulent activity

5. Your Privacy Here

Zero-knowledge encryption keeps us out of your email content, full stop. We do collect some metadata, covered in detail in our Privacy Policy, and signing up means you're fine with how we handle it.

6. Paying for the Service

On paid plans:

  • Payment is due upfront for each billing period
  • Refunds aren't offered outside what the law requires
  • Pricing changes come with 30 days' notice
  • Your plan renews automatically unless you cancel
  • Unpaid accounts may get suspended or closed

7. Who Owns What

Everything that makes up MailCrypts, the software, text, graphics, logos, and overall design, belongs to us and is protected under copyright, trademark, and related intellectual property law.

8. Where Our Liability Ends

MailCrypts isn't on the hook for indirect, incidental, special, or consequential damages, lost profits, lost data, or similar intangible losses tied to your use of the service, to the extent the law allows.

9. No Guarantees Attached

The service comes as-is and as-available, with no warranties spoken or implied, including anything around merchantability, fitness for a particular use, or non-infringement. We can't promise it'll run without interruption or error.

10. When Accounts Get Closed

We can suspend or shut down your account if:

  • You break these Terms
  • You're using the service for fraud or anything illegal
  • Your account becomes a security risk
  • We're required to by law

Closing your own account is just as easy, do it anytime from your settings.

11. Covering Us If Something Goes Wrong

If your use of MailCrypts, or a violation of these terms, leads to claims, damages, or losses against us, you agree to cover those costs, including legal fees.

12. Which Laws Apply

Swiss law governs these Terms, and any dispute gets settled in Swiss courts, regardless of conflict-of-law rules elsewhere.

13. Updating These Terms

We can update these Terms whenever needed. Material changes get posted here with a new "last updated" date, and sticking around after that means you're on board with the update.

14. If One Part Falls Apart

Should any part of these Terms turn out unenforceable, that piece gets trimmed down to what works, and everything else stays intact.
